The short answer is that a lot has to happen before you can win your personal injury case. The key here is if you settle too early, and then need additional treatment or suffer additional harm, you will not be able to recover money for all treatments and damages. Once you heal, further steps must be taken before settling. You must Draft a Demand, file a Complaint with the Court and wait for a response. When your complaint is answered both parties will have to share their Discovery regarding the case. A judge will then instruct Mediation between both parties. If mediation fails you will then go to court, which can take up to a few months to a year to be calendared in. As you can see, a lot has to occur before a case is over.
